We have set forth this Privacy Policy (as modified from time to time, this “Privacy Policy”) to explain how we, Aysu, LLC and our affiliates (collectively, “Company”, “we”, “us”, or “our”) may collect, protect, share and use your information as part of our technology platforms, including without limitation, our company websites, web pages, mobile sites, mobile apps, social media pages, controlled widgets embedded in communication platforms with a link to this Privacy Policy, hardware, virtual reality headsets and other related virtual reality gear and software (the “Sites”).

Your use of the Sites constitutes your acceptance of this Privacy Policy and consent to the terms and practices described herein. We may update or revise this Privacy Policy from time to time, at our sole discretion. You agree to review this Privacy Policy periodically. Your continued use of the Sites following the posting of any updated or revised Privacy Policy constitutes your acceptance of such updated or revised Privacy Policy. We will use your Personal Information (as defined below) in a manner consistent with this Privacy Policy in effect at the time you submitted the Personal Information (as defined below).

I. INFORMATION COLLECTED

a) You may visit, browse or otherwise use the Sites without providing personally identifiable information about yourself (other than Usage Information (defined below) and as described in Section I.d) below). However, this may limit your ability to receive certain features, products or services from us.

b) Personal Information: If you register at the Sites, enter a promotion or purchase a product, opt-in to receive emails or other offers or communications, or otherwise use the Sites and provide personally identifiable information about yourself, we may collect, store, and process information that can be used to identify you as an individual such as (i) your name, email, telephone number, or home address, and other information, such as demographic information (e.g., gender, age) or information about your product preferences and interests, (ii) biometric information, (iii) voice recordings or hand tracking data, (iv) internet or other electronic network activity information, (v) geolocation data, including precise device location if you choose to allow us to collect it (vi) sensory data, and (vii) audio or visual information, including photos and videos, if you choose to provide such information (collectively, “Personal Information”). We also receive additional information about you from third parties, including partners that provide us information that is publicly or commercially available, or from Devices (defined below), and may combine that information with the other information we collect about you.

c) Usage Information: Company and third-party service providers may use a variety of technologies that passively or automatically collect information about how the Sites are accessed and used (“Usage Information”), including internet or other electronic network activity information, your browser type, device type, operating system, application version, the pages served to you, the time you browse, preceding page views, and your use of features or applications on the Sites. This statistical data helps us understand what is interesting and relevant to users of the Sites so we can best tailor our content and develop our products or services.

d) Cookies and Other Data: Like many websites, we may use data files placed on a computer, mobile device, technology or another device (collectively, the “Devices”) when it is used to visit the Sites to facilitate site navigation and to personalize your experience, including tailoring advertisements or offers likely to appeal to you, based on your interests, preferences, location, or demographic information. If you would prefer not to accept cookies, you can change your browser settings to notify you when you receive a cookie, which lets you choose whether or not to accept it; or set your browser to automatically not accept any cookies. However, please be aware that by doing so, some features and services on our Sites may not work properly.

II. USE AND SHARING OF INFORMATION/PERSONAL INFORMATION

a) Company uses the information we collect about you, including Personal Information, for a variety of business purposes, including without limitation the uses listed below, and you consent to such use by us:

1. responding to your questions and requests;
2. providing you with access to certain areas and features of the Sites;
3. verifying your identity;
4. fulfilling product purchases;
5. communicating with you about your account and activities on the Sites;
6. sending notice of changes to Company’s policies;
7. tailoring content, advertisements, and offers we provide you;
8. improving the Sites and for internal business purposes; and
9. processing applications and transactions

Except pursuant to Sections II.b), II.c), II.d) or II.e) below or as otherwise provided in this Privacy Policy, we will not provide any of your Personal Information to any third parties without your consent and we will not disclose credit card or other personally identifiable financial information other than as necessary to complete a credit card or other financial transaction, upon explicit permission from the applicable user.

You agree that we may share or otherwise disclose your information as disclosed at the time you provide your information, as set forth in this Privacy Policy and in the following circumstances:

b) Third Parties Providing Services On Our Behalf. We may share or disclose your Personal Information with and to third parties that perform functions on our behalf (or on behalf of our partners) such as service providers that host or operate our Sites, analyze data, process transactions and payments, fulfill orders or provide customer service; advertisers; sponsors or other third parties that participate in or administer our promotions, contests, sweepstakes, surveys or provide marketing or promotional assistance.

c) Public Information. Certain information you enter into your account or profile, such as your ID, your system-generated user ID, and avatar, may be public and visible to people on and off the Sites.

d) Business Transfers. We may share or disclose your Personal Information with and to other entities and our affiliates in the family of companies controlled by us for internal reasons, primarily for business and operational purposes. As we continue to develop our business, we may sell or purchase assets. If another entity acquires us or our assets, or assets related to the Sites, Personal Information, Usage Information, and any other information that we have collected about the users of the Sites may be disclosed to such entity as one of the transferred assets.

e) Legal Disclosure. Company may transfer or disclose information, including your Personal Information, Usage Information and IP address, to third parties without your consent to comply with a legal obligation; when we believe in good faith that the law requires it; at the request of governmental authorities conducting an investigation; to verify or enforce our User Agreement or other applicable policies; to respond to an emergency; or otherwise to protect the rights, property, safety, or security of third parties, visitors to our Sites, or the public.

III. YOUR PRIVACY RIGHTS, CHOICE AND ACCESS

Subject to Sections II.b), II.c), II.d) or II.e) above, you may direct us not to share your Personal Information with third parties, not to use your Personal Information for the purpose of providing you with promotional offers, or not to send you newsletters, e-mails or other communications by following the removal instructions in the communication that you receive.

In accordance with our routine record-keeping, we may delete certain records that contain Personal Information you have submitted through the Sites. We are under no obligation to store such Personal Information indefinitely and disclaim any liability arising out of, or related to, the destruction of such Personal Information. In addition, you should be aware that it is not always possible to completely remove or delete all of your information from our databases without some residual data because of backups and other reasons.

IV. CHILDREN

The Sites are not directed to children under 13. We do not knowingly collect, use or disclose personally identifiable information from anyone under 13 years of age. If we become aware that we have unknowingly collected personally identifiable information from a child under the age of 13, we will make reasonable efforts to delete such information from our records.

V. SECURITY OF YOUR INFORMATION

Company maintains reasonable safeguards to protect Personal Information against loss, unauthorized use, disclosure or destruction and when transferring information for processing. However, no electronic data transmission or storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure or warrant the security of any information to you transmit to us. Company restricts authorized access to your Personal Information to those persons who have a legitimate purpose to know that information to provide products or services to you and those persons you have authorized to have access to such information.

VI.(European Union) General Data Protection Regulation (GDPR):

The General Data Protection Regulation (GDPR) was created to align the data privacy laws across all EU countries. The GDPR came into effect on May 25th, 2018 and replaces the Data Protection Directive 95/46/EC. A major update within the GDPR is that the processing of any EU citizens’ information is now protected, regardless of whether the information processing is done within the EU or not, and regardless of where the data controller is located. If you are a citizen of the European Union (EU) or European Economic Area (EEA) and are using the InfiniteVR website, we will maintain your personal data in accordance with the principles of the GDPR as outlined in Addendum of this privacy policy.
